1. Acceptance of Terms
By accessing or using M-Tuma (“the Service”), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.
2. Description of Service
M-Tuma is a multi-tenant subscription lifecycle management platform that enables businesses to manage customer subscriptions, send automated payment reminders via SMS, and reconcile payments through M-Pesa and other supported providers.
3. Account Registration
You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information during registration and keep your account information up to date.
4. Acceptable Use
You agree not to use the Service to:
- Send unsolicited messages or spam to contacts who have not consented to receive communications from you.
- Violate any applicable laws or regulations, including those governing data protection, telecommunications, and financial services.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Attempt to gain unauthorized access to any part of the Service or its related systems.
- Transmit any content that is unlawful, harmful, defamatory, or otherwise objectionable.
5. SMS Communications
When using the SMS reminder features, you are solely responsible for ensuring that all recipients have consented to receive messages from you in compliance with applicable telecommunications laws. M-Tuma acts as a conduit only and is not liable for the content of messages you send or any regulatory non-compliance on your part.
6. Payment and Billing
Access to certain features of the Service may require payment of fees. All fees are non-refundable unless otherwise stated. We reserve the right to modify our pricing at any time with reasonable notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.
7. Data Ownership
You retain ownership of all data you input into the Service, including customer records and subscription data. By using the Service, you grant M-Tuma a limited license to process and store your data solely for the purpose of providing the Service to you.
8. Intellectual Property
The Service, including its software, design, and content, is owned by Phira Inc. and is protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without our prior written consent.
9. Disclaimer of Warranties
The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. M-Tuma does not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
10. Limitation of Liability
To the fullest extent permitted by law, Phira Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.
11. Termination
We reserve the right to suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.
12. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
